    California’s Lemon Law—often called the Song-Beverly Consumer Warranty Act—generally helps consumers when a manufacturer can’t fix a significant warranty-covered defect after a reasonable number of attempts. For EVs, the battery and its thermal management system are central to the vehicle’s use, value, and safety. If cooling problems cause heat-related shutdowns, restricted power, or chronic charging failures, those defects may be “substantial” under the law because they interfere with core functions and may raise safety concerns.

    What counts as a “reasonable number” of repair attempts depends on the circumstances. California’s legal “presumption” (within the first 18 months or 18,000 miles from delivery) points to possible lemon status if: the manufacturer has made at least two attempts to repair a defect that could cause serious injury or death, at least four attempts for other defects, or the vehicle has been out of service for repair for a total of 30 or more days. These are guidelines, not strict requirements; cases outside the presumption window can still succeed, and each situation is fact-specific.

    If a vehicle qualifies, potential remedies under the statute can include a replacement or repurchase (buyback), typically with a mileage-based usage offset. EV-specific costs—like registration fees, finance charges, and certain incidental expenses—may also be addressed, depending on the facts and the law. Used vehicles can sometimes be covered if sold with a manufacturer’s warranty. Because outcomes turn on details such as warranty status, repair history, and the nature of the defect, a consultation is important to understand your options.

    Signs of EV Battery Cooling Failure, Repairs, and Records

    EV battery cooling issues often show up as warning lights, a “reduced power” or “limp” mode, fast charging that suddenly slows down or stops, fans running loudly, or dashboard messages about high-voltage system temperature. Some drivers notice range drops during hot weather, charging disabled until the system cools, or the A/C struggling because it’s being diverted to cool the battery. In certain cases, you might smell coolant, see leaks, or experience repeated thermal-related shutdowns after quick-charging or freeway climbs.

    Repairs may involve coolant pumps, valves, chiller modules, heat exchangers, sensors, software updates, and even wiring or control units that govern thermal management. Manufacturers sometimes release technical service bulletins (TSBs) or extended warranties for known cooling defects. Avoid modifying the cooling system or battery, and check for recalls and TSBs before appointments.
